Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Unchain: Break Free application (the "App"), including its website (tryunchain.app) and all associated services, you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree to these Terms, you are prohibited from using or accessing the App.

These Terms constitute a legally binding agreement between you and Nomadan Apps Ltd ("Company," "we," "our," or "us").

2. Description of Service

Unchain: Break Free is a personal wellness and recovery support application designed to help users build healthier habits. The App includes streak tracking, brain rewiring progress visualization, distraction games, guided meditation and breathing exercises, journaling, mood tracking, an anonymous community, a leaderboard, and educational content about addiction neuroscience.

The App operates without traditional user accounts. Users are identified by an anonymous device identifier -- no email, password, or personal information is required to use the App. Certain features (community posts, leaderboard) require a server connection.

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice.

3. Not Medical or Therapeutic Advice

THE APP IS NOT A MEDICAL DEVICE, THERAPY TOOL, OR CLINICAL TREATMENT. It is designed solely as a personal wellness and recovery support tool. The content provided in the App -- including recovery tips, brain rewiring information, neuroscience-based content, community posts, and any other materials -- should NOT be considered medical, psychological, psychiatric, or clinical advice, diagnosis, or treatment.

The App does not create a doctor-patient, therapist-client, or any other healthcare provider relationship between you and Nomadan Apps Ltd.

Always seek the advice of a qualified healthcare provider, therapist, or counselor with any questions you may have regarding a medical condition, mental health condition, or substance use disorder. Never disregard professional medical advice or delay in seeking it because of something you have read or experienced in the App.

If you are in crisis, experiencing suicidal thoughts, or having a medical emergency, contact emergency services (911 or your local equivalent) immediately. The App is not designed for crisis intervention.

4. No Guaranteed Outcomes

The App provides tools and information to support your recovery journey, but we expressly disclaim any guarantee of specific outcomes or results. Recovery is a deeply personal process and results vary significantly for each individual. The "90-day brain rewiring" concept presented in the App is based on general neuroscience research and is for motivational and educational purposes only -- it is not a clinical promise or guarantee that neurological changes will occur within any specific timeframe.

Streak data, progress metrics, and brain rewiring visualizations are motivational tools only and do not constitute clinical assessments of your health or recovery status. You acknowledge that all wellness activities carry inherent variability, and you accept full responsibility for your personal decisions based on information provided by the App.

5. Eligibility

You must be at least 17 years old to use the App. By using the App, you represent and warrant that you meet this age requirement. The App deals with mature subject matter related to addiction recovery and is not intended for children.

6. Anonymous Usage and Device Identification

The App does not require account registration. Instead, a unique anonymous device identifier is generated on your device during initial setup. This identifier is used to associate your activity with community features, the leaderboard, and subscription management.

A randomly generated display name (e.g., "BraveLion_42") is assigned to you for community features. You may change your display name once per week.

You acknowledge that if you uninstall the App, reset your device, or clear app data, your anonymous device identifier and all locally stored data (including streaks, journal entries, mood history, and progress) may be permanently lost and cannot be recovered by us. Your community posts and leaderboard data stored on our servers may also become inaccessible.

7. Subscriptions and Payments

The App offers a free tier with core features and subscription-based access to premium features ("Pro"). Subscriptions are billed exclusively through Apple's App Store and managed by RevenueCat using your anonymous device identifier. All payments are subject to Apple's terms and conditions.

  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
  • You can manage or cancel your subscription at any time through your Apple ID settings.
  • Payment will be charged to your Apple ID account at confirmation of purchase.
  • Refunds are handled by Apple according to their refund policies. We do not process refunds directly.
  • You may restore previous purchases at any time from the App's settings screen.
  • We reserve the right to change subscription pricing at any time. Price changes will take effect at the start of the next billing period following notice to you.

7.1 Free Plan

The features available in the free plan may change at any time based on business needs without prior notification. We reserve the right to modify, limit, or discontinue any aspect of the free plan at our sole discretion.

8. Community Guidelines and User Conduct

The App includes community features where users can share posts anonymously. When using these features, you agree not to:

  • Post content that is abusive, threatening, harassing, defamatory, or discriminatory
  • Post content that promotes, glorifies, or trivializes pornography, substance use, or addictive behaviors
  • Share personal identifying information about yourself or others
  • Post spam, advertisements, or commercial solicitations
  • Post content that is illegal or encourages illegal activity
  • Post content that could be harmful to individuals in vulnerable states of recovery
  • Impersonate another person, healthcare provider, or professional
  • Provide specific medical, psychiatric, or therapeutic advice to other users
  • Use the community to distribute malware, viruses, or other harmful code
  • Manipulate the leaderboard or community engagement metrics through deceptive means

You are solely responsible for the content you post. Be respectful and supportive of others on their recovery journey.

9. Content Moderation

We reserve the right to review, moderate, and remove any user-generated content that violates these Terms or our community guidelines, at our sole discretion and without notice. We may use automated tools and manual review to monitor content. Repeated or severe violations may result in suspension or termination of your access to community features.

We are not responsible for the accuracy, completeness, reliability, or appropriateness of any user-generated content posted in the community. User posts do not represent our views, and we do not endorse any user content. Community content should never be treated as professional advice.

10. Intellectual Property

All content, design, graphics, code, and functionality in the App are owned by Nomadan Apps Ltd or its licensors and are protected by applicable intellectual property laws, including copyrights and trade secrets. The names, logos, and any other identifiers related to the App, such as "Unchain" and "Break Free," are the property of the Company. You may not copy, modify, distribute, sell, or create derivative works based on the App without our prior written consent.

By posting content in the community, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to display, distribute, and use that content within the App and for the purposes of operating and improving the service.

11. Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. NOMADAN APPS LTD EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

NOMADAN APPS LTD MAKES NO WARRANTY THAT: (A) THE APP WILL MEET YOUR REQUIREMENTS; (B) THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE RESULTS OBTAINED FROM THE APP WILL BE ACCURATE OR RELIABLE; (D) THE APP WILL PRODUCE ANY SPECIFIC HEALTH, WELLNESS, OR RECOVERY OUTCOMES; (E) ANY CONTENT, INCLUDING NEUROSCIENCE INFORMATION AND RECOVERY TIMELINES, WILL BE APPLICABLE TO YOUR INDIVIDUAL CIRCUMSTANCES.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NOMADAN APPS LTD AND ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY OR OTHER USER WITHIN THE APP; (C) ANY CONTENT OBTAINED FROM THE APP; (D) ANY HEALTH, WELLNESS, OR RECOVERY DECISIONS YOU MAKE BASED ON THE APP'S CONTENT; (E) ANY RELIANCE ON STREAK DATA, PROGRESS METRICS, OR BRAIN REWIRING VISUALIZATIONS; (F) ANY INTERACTIONS WITH OTHER USERS IN THE COMMUNITY; (G) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR DATA; (H) LOSS OF LOCALLY STORED DATA DUE TO APP DELETION, DEVICE RESET, OR OTHER CAUSES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE APP DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

13. Assumption of Risk

You acknowledge that addiction recovery involves inherent risks and challenges. You use the App at your own risk and assume full responsibility for your actions, decisions, and well-being while using the App. The App is a supplementary support tool and is not a replacement for professional treatment, therapy, or medical care.

14. Indemnification

You agree to defend, indemnify, and hold harmless Nomadan Apps Ltd, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney's fees) arising from: (a) your use of and access to the App; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; (d) any claim that your content caused damage to a third party; (e) any health or wellness decisions you make based on the App's content; (f) any interactions with other users through the community features.

This defense and indemnification obligation will survive these Terms and your use of the App.

15. Third-Party Services

The App integrates with the following third-party services:

  • Apple App Store -- Payment processing and subscription billing
  • RevenueCat -- Subscription management and purchase verification
  • Firebase (Google) -- Analytics and crash reporting

Each of these services has its own terms of service and privacy policies. We are not responsible for the practices of these third parties.

16. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the App will immediately cease.

All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

17. Changes to These Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by posting the updated Terms in the App or on our website. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the new terms, you are no longer authorized to use the App.

18. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Cyprus, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by the competent courts of Nicosia, Cyprus. The language of the proceedings shall be English.

19. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nomadan Apps Ltd regarding the App and supersede any prior agreements.
